1. Agreement to Terms

By accessing or using the ART Ghana website or platform (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all visitors, clients, consultants, and users of the platform.

2. Our Services

ART Ghana provides a research consultancy platform that facilitates:

• Matching clients (organisations and students) with vetted research consultants.
• Quality assurance of research deliverables through plagiarism detection, originality screening, and senior review.
• Research defence panel services for academic and professional work.
• Research training and academy programmes.
• Custom web application and software development services, including web portals, client management systems, and digital infrastructure for organisations.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts

When you register for an account, you agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorised access to your account.
• Not share your account with others or create accounts on behalf of third parties without authorisation.

We reserve the right to terminate accounts that violate these terms or engage in fraudulent activity.

4. Client Obligations

As a client using our platform, you agree to:

• Provide clear and accurate project briefs to enable consultants to deliver quality work.
• Use research deliverables only for lawful purposes.
• Not misrepresent commissioned research as your own original work in academic contexts where this is prohibited.
• Pay agreed fees promptly and in accordance with the project agreement.

5. Consultant Obligations

As a consultant on our platform, you agree to:

• Deliver original, high-quality work that meets the agreed brief and ART Ghana's quality standards.
• Maintain client confidentiality and not disclose project details to third parties.
• Comply with the Non-Disclosure Agreement signed during onboarding.
• Not submit plagiarised or improperly sourced work.
• Accurately represent your qualifications and experience.

6. Intellectual Property

Upon full payment, clients receive full ownership of the final research deliverable. ART Ghana retains the right to use anonymised, aggregated insights from completed projects for quality improvement and statistical reporting only.

All content on the ART Ghana website (including text, logos, and design) is the property of ART Ghana and may not be reproduced without written permission.

7. Payment and Refunds

Payment terms are agreed upon at project commissioning. In general:

• A deposit may be required before project commencement.
• Final payment is due upon delivery of the completed, quality-assured deliverable.
• Refunds are considered on a case-by-case basis where deliverables materially fail to meet the agreed brief despite revision.

8. Limitation of Liability

To the fullest extent permitted by law, ART Ghana shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability in connection with any claim shall not exceed the fees paid by you for the specific project giving rise to the claim. We do not guarantee specific research outcomes, academic grades, or business results.

9. Prohibited Use

You may not use the Service to:

• Engage in any unlawful activity under Ghanaian law.
• Harass, threaten, or harm other users or consultants.
• Circumvent our platform to conduct transactions directly with consultants introduced through ART Ghana.
• Upload malicious code, spam, or fraudulent content.

10. Governing Law

These Terms of Service are governed by the laws of the Republic of Ghana. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Ghana. We encourage you to contact us first to resolve any dispute informally before pursuing formal proceedings.
